Civil Procedure II

The course will begin with a condensed review of pleading under the Federal Rules of Civil Procedure; this will include a brief coverage of pleading in securities fraud actions, which is not covered in the first-year course. This will be followed by: (1) joinder of claims and parties (including counterclaims, crossclaims, permissive and compulsory joinder of parties, third-party practice, intervention, and interpleader); (2) a brief overview of the class action; (3) discovery; (4) summary judgment; (5) case management (pretrial conference and orders); (6) a brief overview of the trial process; and (7) post-trial motions. Federal subject matter jurisdiction and appellate review will be treated as relevant to the subjects covered.
