LAW 7143 :
Patent Trial Practice

Prerequisite: Intellectual Property (LAW 7048); May be taken concurrently. This course will focus on patent invalidity trials at the Patent Trial and Appeal Board (PTAB) after issuance of a patent; specifically Inter Partes Review Post Grant Review and the Transitional Program for Covered Business Method Patents. The Class Discussion session will cover the statutory framework, and procedures of these trials. The practicum session will include drafting of the petitions, motions, responses, discovery and submission of evidence. Both sessions will teach or reinforce basic principles of patent law that are necessary for determining validity of patent claims. In the four years since inception, post-grant invalidity trials have become a parallel proceeding to almost every patent infringement trial. This course will cover the complex interplay between PTAB trials and concurrent patent infringement civil litigation; including timing bars, stays and issue preclusions. This course is offered on an every other year basis.
