Feminist Legal Theory

This course will expose students to the major paradigms of feminist legal thought and their applications to a number of contemporary legal problems. It will begin with an analysis of the theoretical constructs of legal feminism: formal, constitutional equality; dominance theory; and difference theory. It will then grapple with the critique of these paradigms, including ones based on critical race theory and the intersection of gender, class, and sexual orientation. After mastering the theories and critiques, the course will apply both to a variety of issues, including sexuality, reproductive rights, rape, pornography, domestic violence, and marriage.
