Privacy Law

<p>This course examines the extent to which our legal system protects privacy, including both informational and decisional privacy. The course will focus on the legal protections offered to persons whose privacy has been invaded by individuals, businesses or government entities. Activities such as electronic surveillance, mandatory drug, aids and polygraph testing, and computerized governmental, business and health records, will be examined to determine the current balance in society between the right to know and personal privacy. Common law and statutory remedies for unwarranted publicity of personal and intimate information will also be considered. The evolving contours of decisional privacy will also be explored in the contexts of areas such as contraception, abortion, unorthodox personal lifestyles and death and dying.
